User Agreement

Effective 12 July 2024

Access to and use of the contents and Services provided by TalentVibes on the Electronic Platforms shall be subject to this User Agreement, which includes these Terms and Conditions, TalentVibes Standard Terms for Services, Privacy Policy and any applicable Specific Terms (collectively, “User Terms”). The User Terms are applicable to all individual and/or corporate Members and Visitors accessing and/or using the Electronic Platforms at any time for any reason or purpose (“Users”). When you access and use the Electronic Platforms and the Services, you agree to all of the User Terms.

If you do not accept any of the User Terms, please do not register, join, access, view, download and/or otherwise use any Services offered by TalentVibes on the Electronic Platforms. By your continued use of the Electronic Platforms, you acknowledge that you have read and understood the User Terms, and that you agree to be bound by all of its provisions. TalentVibes reserves the right to amend, add to, delete or revise all or part of the User Terms at any time without prior notice. You are advised to periodically review the User Terms, in particular, the Privacy Policy. Your access to the Electronic Platforms and TalentVibes’ services will be terminated upon your notice to TalentVibes that any change is unacceptable; otherwise your continued use of the Electronic Platforms and TalentVibes’ services shall constitute your acceptance of all changes and they shall be binding upon you.

1. Definitions

In these Terms and Conditions, the following terms shall have the respective meanings specified below unless the context otherwise requires:

“Advertisers” means a User who places a job advertisement or promotes any job related activities via the Electronic Platforms.

“Candidates” means individual Members or Visitors accessing and/or using the Electronic Platforms at any time.

“Database” means the database that TalentVibes uses to store User data.

“Electronic Platforms” means any website, job portal or mobile application owned and operated by TalentVibes.

“Employers” means any potential employer which engages TalentVibes for the purposes of recruitment services.

“TalentVibes” means the applicable TalentVibes entity in your jurisdiction for the Services, as follows: Talent Vibes Vietnam Limited Liability Company (https://talentvibes.io/)

“Members” means users who have registered, joined and/or signed-up for use of the Services. If you have chosen not to register for our Services, you may access certain features as a “Visitor”.

“Privacy Policy” means TalentVibes’ Privacy Policy, accessible on this page, and which form part of the User Agreement.

“Relevant Advertiser” means Advertisers which TalentVibes deems are relevant for fulfillment of the relevant Services being performed for the applicable User.

“Rest of the World” means all countries other than the Designated Countries.

“Services” means these services offered by TalentVibes to Users on the Electronic Platforms.

“Specific Terms” means a set of terms applicable only to a particular Service, and which form part of the User Agreement in respect of that Service.

“Standard Terms” means TalentVibes’ Standard Terms for Services, accessible on this page, and which form part of the User Agreement.

“Terms and Conditions” means these terms and conditions, which form part of the User Agreement.

2. Electronic Platforms Acceptable Use Policy

Applicable to Candidates:

  • You (Candidate) agree that you shall only use the Electronic Platforms for lawful purposes.

  • You agree to keep your login identification and password with care and not to disclose them to any other person. You are solely responsible for maintaining the confidentiality, safekeeping and security of such login name and password and shall notify TalentVibes immediately of any unauthorised use of the same.

  • You confirm and acknowledge that you disclose your personal data and all other information to the Advertisers and/or TalentVibes on your own volition when you submit, upload or post your resume and/or personal data on the Electronic Platforms, and apply for available job vacancies posted on or through the Electronic Platforms. By submitting, uploading or posting your resume and/or personal data on the Electronic Platforms, you authorise TalentVibes to store your resume and information or data related thereto in the Database. You may send your resume and the related information or data directly to any Advertiser who advertises on or through the Electronic Platforms. Alternatively, you may send your resume and the related information or data to TalentVibes through the Electronic Platforms in reply to any job advertisement. In such an event, your resume and the related information and data will remain active on the Electronic Platforms and be stored in the Database at your own risk unless and until you choose to delete them. You acknowledge and agree that your resume and the related information and data may be disclosed and/or accessed by the Advertisers who have subscribed to the services of TalentVibes for the sole purpose of recruiting and assessing the suitability of you. TalentVibes also reserves the right to reject, disapprove or edit any part of the your resume and information and/or data related thereto as it sees appropriate and to erase any personal data which TalentVibes reasonably believes that such information or data is inaccurate, false, illegal, unlawful, infringes copyright / trademark / trade name / trade secret or infringes any other intellectual property rights or invades the privacy of the other having regard to the purpose (including any directly related purpose) for which the data are or are to be used.

  • You acknowledge and agree to TalentVibes’ practice in certain jurisdictions of charging Advertiser a fee for access to certain Electronic Platforms and/or Candidates’ resumes, details, information and data related thereto in the Database for the sole purpose of recruiting and assessing the suitability of Candidates and subject to the terms herein. You also recognise that you shall have no claims to any such fee received by TalentVibes.

  • You acknowledge and agree that TalentVibes may, release Candidates’ resumes and/or relevant personal information (which includes, name, contact information such as email address or phone number, profile photo, date of birth, nationality, residency status, gender, identification number and other relevant information that is/are not publicly available required for us to perform the Services such as salary, education level, work experience, preferences and interests) (“Relevant Personal Information”) in the Database to Relevant Advertiser(s) and/or Employers through the use of TalentVibes’ search engine or any other means for the purpose of fulfilling the Services performed for the Candidate and/or enabling Relevant Advertiser and/or Employers to recruit and assess the suitability of Candidates in relation to any job vacancy. You consent to TalentVibes doing the same to your resume and Relevant Personal Information.

  • TalentVibes will not release your personal data to any Advertiser without your permission unless in accordance with this User Agreement, if required by any authorised institution or obliged under the prevailing laws and regulations.

  • You agree that TalentVibes may use your personal data (without your name, address and other personal identifiable information) for marketing purposes which may be directed to either potential Advertisers, their respective agents or anyone under their employ.

  • Although TalentVibes shall use its reasonable endeavors to restrict access to the Database only to personnel of TalentVibes, it does not guarantee that other parties will not, without TalentVibes’ consent, gain access to the Database. However, you acknowledge that the Advertisers and other parties may have retained a copy of your resume through use of our Services. TalentVibes is not responsible for the retention, use or privacy of resumes in these instances, or for the use or privacy of resumes by any of such parties while the resumes are in the Database.

  • TalentVibes will not be responsible or held liable in any way if any Advertiser or other user, in breach of the User Terms, whether in Singapore or elsewhere, uses your personal data, information or materials for any purpose other than for recruiting potential employees. You accept that all personal data, information or materials given to Advertiser or other users, or submitted on or through the Electronic Platforms, are given entirely at your own risk.

Applicable to Advertisers:

  • You (Advertiser) agree that you shall only use the Electronic Platforms for lawful purposes and only for promoting job related activities or recruitment. If you have elected to also acquire any other services from TalentVibes, and if that service requires use of the Electronic Platforms, this User Agreement is to be read in conjunction with the applicable service’s service terms .

  • Upon payment of the service fee to TalentVibes or upon acceptance of any free trial promotion offer, you will be entitled to use the applicable Electronic Platform to advertise job vacancies for a predetermined period following agreement of the predetermined service, save and except for free trial promotion offer (if applicable). Subject to the conditions or requirements from time to time stipulated by TalentVibes regarding the access to Candidate’s information or data, you may be provided information from the Database by TalentVibes personnel and agree that all information and data obtained as a result of such access shall only be used for the sole purpose of recruiting and assessing the suitability of Candidates and that such information or data shall not be disclosed to any other parties without the prior consent of the Candidate concerned. You acknowledge and agree that you shall disregard any information and data received from Candidate which is irrelevant to recruiting and assessing the suitability of Candidates.

  • You shall be solely responsible for the contents of and materials contained in its advertisement posted on the Electronic Platforms. TalentVibes reserves the right to remove or edit, or require the removal or amendment of, any advertisement as it sees appropriate, or to terminate or suspend your access and use of the Electronic Platforms and/or services offered on or through the Electronic Platforms, in accordance with the agreement for such services between you and TalentVibes.

  • Without prejudice to any other rights of TalentVibes in the User Terms, TalentVibes shall have the right to suspend or terminate any services offered to any Advertiser, any Advertiser’s use of the Electronic Platforms, and remove any advertisement posted on the Electronic Platforms at TalentVibes’ sole discretion, without any compensation or recourse to Advertiser in the event that the relevant Advertiser or the contents of the relevant advertisement is or are in breach of any of the User Terms (including the Terms and Conditions, Standard Terms, Privacy Policy, Specific Terms) or any other service specifications. In the event that TalentVibes decides to remove an advertisement or web page for any reasons not relating to any breach of the provisions herein or any of the provisions in the User Terms or any TalentVibes Products’ specifications, TalentVibes may after deducting the fees charged for the period that the advertisement or web page has been posted on the Electronic Platform(s), refund the remaining fees (if any) to the relevant Advertiser.

  • From time to time TalentVibes may invest in marketing campaigns to promote your Advertiser brand (including but not limited to Google ads, Yahoo – Bing ads, Baidu ads, Facebook ads, Twitter ads, ad networks, Demand Side Platforms, Real Time Bidding, retargeting and other programmatic buying strategies) and you acknowledge that such promotion may be on a third party website or application.

  • TalentVibes also reserves the right to change the service fee or institute new charges or fees, from time to time, as it deems appropriate. In the event that any Advertiser fails to pay the service fee or any other fees or charges due to TalentVibes, TalentVibes reserves the right to suspend or terminate the Advertiser’s advertisement and/or Service, without prejudice to all other rights and remedies available to TalentVibes.

Prohibited Uses – All Users:

  • Users agree(s) that:
    (a) Candidate shall not post any non-resume related information or data and/or incomplete, false or inaccurate resume related information or data on the Electronic Platforms.
    (b) Candidate shall not respond to any job vacancy advertisement for any reason other than to apply for the job advertised, and Advertiser shall not respond to any Candidate other than in connection with Candidate’s application for a job. Any communications or use of the Electronic Platforms for any purposes other than recruitment purposes, including but not limited to soliciting of donations or business for any reason, are strictly prohibited.
    (c) All Users shall not use the Electronic Platforms in any manner that infringes the intellectual property rights or proprietary rights of others.
    (d) All Users shall not use, print, download, duplicate, transmit or otherwise copy, reproduce, redistribute or republish any personal data about other Users save and except that the Advertisers may use Candidates’ information from the Database in accordance with these Terms and Conditions. Any unauthorised use of personal data is strictly prohibited and shall constitute a gross breach of the User Terms, in particular any unsolicited communications of any type to Users and/or the use of personal data obtained by Advertisers from TalentVibes’ Services for their marketing purposes.
    (e) All Users shall not delete, revise or remove any material posted by any other person or entity.
    (f) All Users are prohibited from violating or attempting to violate the security of the Electronic Platforms including, without limitation, accessing data not intended for them or logging into a server or account which they are not authorised to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorisation, attempting to interfere with service to any user, host or network or sending unsolicited e-mails, including promotions and/or advertisements for products or services. Violations of system or network security may result in civil and/or criminal liabilities.
    (g) All Users shall not upload, post, publish, transmit, distribute, circulate or store any material in whatsoever way relating to the Electronic Platforms(i) in violation of any applicable laws or regulations; (ii) in any manner that may infringe the copyright, trademark, trade secrets or other intellectual property rights or proprietary rights of others or violate the privacy or publicity or other personal rights of others; (iii) that is harmful, defamatory, libelous, obscene, discriminatory, harassing, threatening, abusive, hateful, racist, blasphemous, false, illegal, improper or is otherwise offensive or objectionable; (iv) in the manner that causes unrest in politics, religion, national security or stability and/or reputation of TalentVibes; or (v) that contains viruses, trojan horses, worms, corrupted files or other materials or programs that may interrupt, damage or limit the functionality and operation of the Electronic Platforms, the Services offered on the Electronic Platforms, or of any computer software or hardware or telecommunication equipment.
    (h) All Users are prohibited in using screen scraping, data mining, robots or similar data gathering and extraction tools on the Electronic Platforms for establishing, maintaining, advancing or reproducing information contained on the Electronic Platforms on your own website or in any other publication, except with our prior written consent.

3. Intellectual Property Rights

All contents of the Electronic Platforms, including without limitation, information, text, graphics, images, layout, designs, pictures, logos, editorial content, HTML and/or other proprietary materials on the Electronic Platforms (collectively “Contents”) are the intellectual property of TalentVibes, TNEX or its licensors and are protected by copyright, trademark, patent and other intellectual property laws. Users acknowledge and agree that the Contents are made available solely for their personal non-commercial use. Except as otherwise provided in this paragraph, users shall not, and shall not procure, assist or facilitate any third party to, copy, reproduce, transmit, publish, disseminate, distribute, redistribute, broadcast, circulate, store (in any medium), display, modify, sell or transfer or participate in the sale or transfer of or offer for sale of, create derivative works from, or in any way exploit any of the Contents, whether in whole or in part. Users may download or copy the Contents solely for their personal non-commercial use and/or users that are expressly permitted in these Terms and Conditions, provided that Users will not delete or amend any symbols or statements in the Contents that indicate the subsistence therein of copyright, trademark and any other proprietary rights. Users do not have any right, title or interest in or to any or any part of the Contents as a result of such downloading or copying. TalentVibes reserves all its rights of enforcement of all its intellectual property rights or proprietary rights in the Contents, including without limitation against any use of any of the Contents that is not expressly permitted under the Terms and Conditions. For the avoidance of doubt, any purported consent of any third parties (including Advertisers) to the use of the Contents or any part thereof shall not in any way exonerate the users from the restrictions/prohibitions imposed hereunder in whatsoever manner.

4. Responsibility

TalentVibes reserves the right to monitor the Electronic Platforms and its contents at any time, but is not obliged to do so. TalentVibes takes no responsibility whatsoever for any material on the Electronic Platforms that is not posted by TalentVibes or is otherwise posted by TalentVibes on behalf of a User. All Users acknowledge and agree that they are fully responsible for the form, content and accuracy of any resume, information, data, advertisement, web page and/or material submitted by them to TalentVibes or that is otherwise posted by them on or through the Electronic Platforms. TalentVibes does not warrant that any resume, information, data, advertisement or web page will be viewed by any specific number of users or that it will be viewed by any specific user or result in successful recruitment of personnel. TalentVibes shall not in any way be considered an agent of either Advertiser or Candidate with respect to any use of the Electronic Platforms. TalentVibes shall not be responsible in any way for any decision, for whatever reason, made by any party seeking or posting jobs on the Electronic Platforms, or of any party responding to or posting advertisements on the Electronic Platforms. Whilst TalentVibes has endeavored to provide a quality service to users, Advertisers and candidates, it does not warrant that the Electronic Platforms will operate error-free or that the Electronic Platforms and its server are free of viruses or other harmful mechanisms, that any defects will be corrected, or that the operation of the Electronic Platforms will be uninterrupted, timely or secure. If use of the Electronic Platforms or its contents result in the need for servicing or replacing equipment or data, by any user, TalentVibes shall not be responsible for those costs and any loss or damage of whatever nature. The Electronic Platforms and their contents are provided on an “as is” basis without any warranties of any kind. To the fullest extent permitted by law, TalentVibes disclaims all warranties, including without prejudice to the foregoing, any warranties in respect of merchantability, availability of featured products or services, non-infringement of third party rights, fitness for particular purpose, or about the accuracy, reliability, completeness, timeliness or other qualities of the Electronic Platforms and the contents, services, software, text, graphics and links contained therein. Users should independently assess and verify the accuracy, completeness and reliability of the information on the Electronic Platforms and to seek professional advice where necessary.

5. Own Risk

All Users use the Electronic Platforms and any other websites accessed through it, entirely at their own risk. All Users shall be responsible for their own communications and are responsible for the consequences of their activities on the Electronic Platforms. TalentVibes does not represent or guarantee the truthfulness, accuracy or reliability of any of the communications posted by other Users or endorse any opinions expressed by Users. Any reliance by users on any material posted by other Users shall be at their own risk. TalentVibes reserves the right to expel any Users and prevent their further access to the Electronic Platforms at any time for breaching the User Terms or violating applicable laws and regulations and also reserves the right to remove any material which is abusive, illegal, disruptive or inappropriate at TalentVibes’ sole discretion without notice and/or consent whatsoever.

6. Links to Other Websites

The Electronic Platforms may contain links to third-party websites. These are provided solely as a convenience to Users and as Internet navigation tools, and not in any way as an endorsement by TalentVibes of the contents on such third-party websites. Unless otherwise stated on the Electronic Platforms, TalentVibes has no control over or rights in such third-party websites and is not responsible for their availability or security. If Users access any linked third-party websites, they do so entirely at their own risk. TalentVibes shall not be responsible for the contents of any third-party websites linked to the Electronic Platforms or any links contained in such third- party websites or any changes or updates to the above, and does not make any representations or warranties regarding the contents or accuracy of materials on such third- party websites. TalentVibes shall not be responsible or liable for any loss or damage of any kind arising from or in connection with the use of the services or contents of such third-party websites. Further, any data or materials posted on the Electronic Platforms by any user may be viewed by users of other websites linked to the Electronic Platforms and TalentVibes shall not be responsible for any improper use by any User or third party other than TalentVibes of any data or materials posted on the Electronic Platforms.

7. Indemnity

Without prejudice to any other rights of TalentVibes in the User Terms, all Users agree to indemnify and hold harmless TalentVibes, officers, directors, employees, agents, proprietors, partners, representatives, shareholders, servants, attorneys, predecessors, successors and assigns from and against any claims, actions, demands, injuries, liabilities, losses, damages, costs and expenses (including legal fees and litigation expenses on a full indemnity basis) arising from or relating to the Users’ use of the Electronic Platforms or its contents or the User’s breach of the User Terms (including, for the avoidance of doubt, the Terms and Conditions, Standard Terms, Privacy Policy and Specific Terms), to the fullest extent permitted by applicable law. This indemnification shall be in addition to all other obligations of Users under the User Terms, and shall not prejudice any other rights or remedies available at law to TalentVibes.

8. Disclaimer

To the fullest extent permitted by applicable law, TalentVibes, its officers, directors, employees or agents shall not be liable in any event for damage of any kind suffered by any users whatsoever directly or indirectly arising from or relating to such Users’ use of or inability to use the Electronic Platforms and its contents, including without limitation any errors or omissions in such contents, or any deletion, incorrect or delayed transmission or loss of any contents or materials uploaded or transmitted through the Electronic Platforms.

9. Dealing with Advertisers

User’s communication or business dealings with, or participation in promotions organised by, Advertisers found on or through the Electronic Platforms, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between the user and such Advertiser. TalentVibes shall not be responsible or liable for any loss or damage of any type or nature incurred as a result of any such dealings or as a result of the presence of the Advertisers on the Electronic Platforms or as a result of the accuracy or truthfulness of any information or data posted by the Advertisers.

10. Dealing with Other Users

Notwithstanding TalentVibes uses its best endeavors to provide impartial job seeking and recruitment services, and represents a media supporting information exchanged between Advertisers and Candidates, TalentVibes will not be involved in dealings or disputes between Candidate and Advertiser and TalentVibes shall not be responsible or held liable for the quality, security and legitimacy of the recruitment service. TalentVibes does not warrant or guarantee the accuracy of the information and/or the resume provided by Candidate or of the recruitment advertisements provided by Advertiser. TalentVibes does not guarantee that Advertiser will be able to pay the relevant remuneration or that Candidate will be competent to take the job offered by the Advertiser. Should any dispute arise between Advertiser and Candidate, Advertiser and Candidate shall resolve such disputes between themselves and TalentVibes shall not be responsible and held liable for any disputes thereof.

11. Limitation of Liability

Notwithstanding anything to the contrary in the User Terms, and without prejudice to the above and subject to the applicable laws, the aggregate liability of TalentVibes to any User for all claims arising from or relating to the User’s use of the Services and the Electronic Platforms shall be limited to the fees received by TalentVibes in respect of the Services giving rise to such claims.

12. Termination

In the event that any information provided by the User is inaccurate, in breach of any laws or contains indecent elements, TalentVibes shall instantly abrogate the User’s account and membership without notice and reserves the right to take any action as it considers appropriate, desirable or necessary, including but not limited to taking legal action against such User. TalentVibes reserves the right at any time to immediately terminate or suspend any User’s account or access to the Electronic Platforms without notice, where TalentVibes is of the opinion that the User has breached any of the User Terms or violated any law or regulation, and to take further action as TalentVibes in its sole discretion considers appropriate, desirable or necessary, including removing any material which it deems abusive, illegal, disruptive or inappropriate. TalentVibes shall have the sole and absolute discretion to decide whether the User, Candidate or Advertiser has breached any of the User Terms, and such decision shall be final. In case TalentVibes has not exercised the right under this Clause, it shall not be deemed to be a waiver.

13. Modification to Access or to Electronic Platforms

TalentVibes reserves the right at any time and from time to time to modify, change, suspend, discontinue or restrict (a) Users’ access to, either temporarily or permanently, the Electronic Platforms (or any part thereof); or (b) the whole or any portion of this Electronic Platforms (and the services provided therein), with or without notice. TalentVibes shall not be liable to Users or to any third party for any such modification, change, suspension, discontinuation or restriction.

14. Security Measures

TalentVibes will use its reasonable endeavors to ensure that its officers, directors, employees, agents

and/or contractors exercise their prudence and due diligence in handling the personal data submitted by Candidate and that access to and processing of the personal data by such persons is on a “need-to-know” and “need-to-use” basis. TalentVibes will use its reasonable endeavors to protect Candidates’ personal data against any unauthorised or accidental access, processing or erasure of the personal data.

15. Entire Agreement

The User Terms (including, for the avoidance of doubt, the Standard Terms, Privacy Policy and Specific Terms) shall constitute the entire agreement between User and TalentVibes relating to User’s use of the Electronic Platforms, and shall replace and supersede all other communications (be it written or oral), discussions, letters and contracts relating to the subject matters hereof.

16. Variation of Terms

TalentVibes may vary these User Terms at any time. If TalentVibes varies these User Terms, it will provide notice by publishing the varied User Terms on the Electronic Platforms.

You accept that by doing this, TalentVibes has provided you with sufficient notice of the variation to its User Terms.

17. Order of Precedence

In the event of any conflict or inconsistency between different parts of this User Agreement, the following descending order of precedence applies: (i) these Terms and Conditions, (ii) the Privacy Policy and applicable Specific Terms and (iii) the Standard Terms.

19. Service Specific Terms

A. TalentVibes Credits

  • This Clause is applicable to Services which use TalentVibes Credits (“TalentVibes Credits”).

  • All TalentVibes Credits:

    • shall have an expiry date, which shall be determined on purchase of the TalentVibes Credits;

    • are non-refundable;

    • cannot be withdrawn or transferred to any other Users;

    • cannot be used as payment to any other Users;

    • cannot be exchanged for any currency;

    • cannot be exchanged or used for any other purpose other than the ones offered by the Service;

    • may only be used by the purchaser of the TalentVibes Credits;

    • may only be used for Services provided by TalentVibes and on the Electronic Platform that it was purchased on; and

    • shall also be subject to any rules and directions specified by TalentVibes as displayed on the Electronic Platform that it was purchased on, in particular on usage of such TalentVibes Credits including but not limited to the number of TalentVibes Credits required for receiving the offered Services, payment methods, and so forth.


  • Any decision made by TalentVibes on the usage of TalentVibes Credits shall be final.

Privacy Policy

At TalentVibes, we are committed to safeguarding your privacy and ensuring the protection of your personal data. We adhere to the highest standards of security and confidentiality regarding all personal data submitted by you. This Data Privacy Policy (“Policy”) delineates the practices and procedures we follow for the collection, use, disclosure, and protection of your data. This Policy is applicable to both registered and unregistered users, and its terms may be updated, revised, varied, and/or amended periodically. By utilizing our services, you agree to the terms of this Policy.

By registering for and/or using our services, you agree to the following:

(a) You, as a candidate, shall not post any non-resume-related information or data, or any incomplete, false, or inaccurate resume-related information or data on the Electronic Platforms.

(b) You consent to TalentVibes collecting, using, and/or processing your data for the purposes described herein.

(c) You consent to TalentVibes transferring your personal data under the circumstances described below, including any transfer of your personal data outside of your country.

(d) You consent to TalentVibes sharing your data internally and between Electronic Platforms, and disclosing your data to third-party service providers or agents for the purposes described herein.

1. Interpretation

Candidate(s): A user who has uploaded their resume or data as required on our Electronic Platforms and has consented to the sharing of such data with prospective employers or third parties for the purpose of connecting with potential employers.

Electronic Platforms: All TalentVibes websites and mobile applications, including but not limited to “Talentvibes.io”, “ats.talentvibes.io”, or affiliates such as the Career hub on the TNEX App.

TalentVibes: Refers to Talent Vibes Vietnam Limited Liability Company or the affiliate operating the relevant Electronic Platform for the country in which you reside or where the business is headquartered or located.

Registered User(s): Any user who has registered on any Electronic Platform.

2. Information Collection and Use

2.1 Personal Data: Personal data is any information which can be used to identify you or from which you are identifiable. We may collect personal data when you interact with our staff and through use of our Electronic Platforms. Some examples include your:-

(a) name;

(b) contact information such as email address, phone number, mailing address;

(c) date of birth and nationality;

(d) gender;

(e) identification number (such as a national identity number);

(f) resume, and related information that is/are not otherwise publicly available, including but not limited to profile photo, salary, education level, work experience;

(g) device information (such as device type, browser type and IP addresses); and

(h) preferences and interests.

2.2 Purpose. We collect this data for the following purposes:-

(a) for the daily operation of the services provided to you;

(b) to assist you in finding appropriate employment with employers and to assist employers in assessing the suitability of candidates for a job vacancy for a wide spectrum of jobs and industries;

(c) to provide you with various services offered by TalentVibes and newsletters, information on job openings, and promotional and marketing materials (see section 8 below on “Subscription of Newsletters, Promotional Materials and Marketing Materials”);

(d) to handle and follow up on enquiries, requests, and complaints from you;

(e) to contact you regarding administrative notices and communications relevant to TalentVibes services and to respond to your inquiries or requests;

(f) to assist TalentVibes with developments for future marketing and promoting purposes or other internal purposes;

(g) to verify your identity in posted advertisements, materials, representations, messages, views or comments, or such other information on our Electronic Platforms and/or other platforms;

(h) to identify who viewed the aforesaid information posted on the App;

(i) to allow you to enjoy the benefits of being enrolling for events and promotions hosted by TalentVibes and/or partner companies;

(j) to facilitate TalentVibes to use your data for the purposes relating to the provision of services offered by TalentVibes and marketing services and/or special events of TalentVibes;

(k) to obtain statistics to analyse usage of TalentVibes’s Electronic Platforms and/or other platforms to help its further development and to improve user experience;

(l) to comply with legal obligations; and

(m) for purposes other than the above-mentioned which are related to TalentVibes’s provision of their product and/or services.

TalentVibes strives only to collect personal data which are necessary and adequate but not excessive in relation to the purposes set out hereinabove.

2.3 Consent: You are deemed to have given consent if you voluntarily provide your personal data to us for a purpose and you have the right to withdraw your consent at any time with reasonable notice. If you are a minor, you should seek prior consent from a person with parental responsibility for you, e.g. parent or guardian, who may contact the responsible staff (see section 10 below on “Contact Information”). The prescribed consent should be given by your parent or guardian

2.4 Request for Deletion: You may request for your data to be deleted at any time. To do so, submit a request for user account deletion to our Customer Relations team through email, live chat, Instagram direct, Facebook, or web form. Please share your email address and request (Account Deletion). (see Section 7 for details).

2.5 Sensitive Data: We will not collect or process sensitive personal data, such as racial or ethnic origin, political opinions, religious beliefs, health data, or biometric data, without your explicit consent or unless required by law.

3. Information Transfer and Sharing, and Disclosure

3.1 Internally: We will share your personal data (including resume, employment, and educational history, contact details, salary expectations, and preferred job classifications and locations) with TalentVibes employees and between Electronic Platforms to provide services to you. TalentVibes may also disclose and/or transfer your personal data, in accordance with your instructions, to relevant corporate clients of TalentVibes to assist you in finding appropriate employment. Personal data collected, including on our Electronic Platforms, may be transferred, stored, and processed in any country in which TalentVibes or any member of the TalentVibes operates. By using any of our services, including our Electronic Platforms, you agree to, consent to and authorise TalentVibes to disclose and/or transfer your personal data under the circumstances stated above, as well as to any transfer of data outside of your country.

3.2 TalentVibes Profile: TalentVibes provide all Registered Users with the option of creating a personal “TalentVibes Profile”. A TalentVibes Profile can include a resume, employment, and educational history, contact details, salary expectations, and preferred job classifications and locations. Advertisers who are approved by TalentVibes are able to search the TalentVibes Profile database to find and contact relevant candidates. If you have replied to a job invitation sent by an Advertiser or you have applied for jobs directly on our Electronic Platforms using your profile, that Advertiser will have access to your up-to-date profile, including your contact details (as updated by you from time to time). All data provided when creating a TalentVibes Profile (including your name, resume, email address, telephone numbers, employment, and educational history) may be used by TalentVibes to improve placement opportunities for you (e.g. by sharing such data with potential employers) or for tailoring specific products to you. When you create a TalentVibes Profile on TalentVibes, you consent to your profile being viewed and/or accessed by Advertisers using the Electronic Platforms, which may result in the transfer of your data from your country to the other countries in which the other members of TalentVibes operate. TalentVibes reserves the right to disable or clear a TalentVibes Profile at any time at its sole discretion. Advertisers that place job ads on TalentVibes and purchase TalentVibes Profiles are asked by TalentVibes to comply with all relevant laws and obligations relating to the use and disclosure of personal data. The use of your data (personal or otherwise) by these Advertisers is not within the control of TalentVibes and we cannot accept responsibility for the conduct of these companies

3.3 Social Network Information: In order to provide Advertisers with the most relevant information about you, social network information (including but not limited to GitHub or LinkedIn profiles) that you provide may also be scanned by TalentVibes and relevant content may be displayed to Advertisers. If you do not want content from social networks to be displayed to Advertisers, do not provide social network information. If you register on our Electronic Platforms via your accounts from social networking applications (including but not limited to Facebook, Google, and LinkedIn), you are deemed to have consented to the terms of this Policy, and such your data provided to those networking tools may be obtained by TalentVibes and be used by TalentVibes and its authorised persons in and outside of your country to provide services and marketing materials to you. Where this occurs, you will be provided clear notice by these social networking Apps. TalentVibes and its authorised personnel may gain access to and use your data obtained in such a way, subject to the other provisions of this Policy.

3.4 Third-Party Service Providers: We may share your personal data with trusted third-party service providers in the following circumstances:-

(a) where the information and data is disclosed and/or transferred to any third-party suppliers or external service providers who have been duly authorised by TalentVibes to use such information and data and who will facilitate the services provided to you, under a duty of confidentiality;

(b) where the information and data is disclosed and/or transferred to any agents, affiliates, or associates of TalentVibes who have been duly authorised by TalentVibes to use such information and data;

(c) where permitted under the terms and conditions of TalentVibes services;

(d) where TalentVibes needs to protect and defend its rights and property;

(e) where TalentVibes considers necessary to do so in order to comply with the applicable laws and regulations, including without limitation compliance with a judicial proceeding, court order, or legal process served;

(f) where TalentVibes deems necessary in order to deliver the products and services that we offer and cultivate a positive user experience; and/or

(g) where TalentVibes deems necessary in order to maintain and/or improve the services provided to you.

International Transfers of Personal Data: When we transfer your personal data from your home country, state or city to another country, state or city, we will comply with our legal and regulatory obligations in relation to your personal data, including having a lawful basis for transferring your personal data and putting appropriate safeguards in place to ensure an adequate level of protection for your personal data. We will also ensure that the recipient is obliged to protect your personal data at a standard of protection comparable to the protection under applicable laws. Our lawful basis will be either consent or one of the safeguards permissible by applicable laws.

4. Cookies and Similar Technologies

We use cookies and similar technologies to track user activity on our Electronic Platforms and improve the overall user experience. You have the right to choose to disable, block or deactivate cookies. Please note that however refusal or removal of some cookies could affect the availability, functionality or use of the Electronic Platforms. You can control cookie preferences through your browser settings.

5. Data Security

5.1 Security Measures: The security of your personal data is important to TalentVibes. TalentVibes will always strive to ensure that your personal data will be protected against unauthorised access. TalentVibes has implemented appropriate technical, organisational and managerial measures to safeguard, protect and secure your personal data.

5.2 Compliance With This Policy: All personal data provided by you are only accessible by the authorised personnel of TalentVibes or its authorised third parties, and such personnel shall be instructed to observe the terms of this Policy when accessing such personal data.

5.3 Self-Action: You should safeguard your unique login details and strong password by keeping them secret and confidential and never share these details with anyone.

5.4 No Absolute Guarantee: TalentVibes follows generally accepted industry standards to protect the personal data submitted by you, both during transmission and once TalentVibess receives it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while TalentVibes strives to protect your personal data against unauthorised access, TalentVibes cannot guarantee its absolute security.

5.5 Links To Other Websites and/or Applications: The Electronic Platforms may provide links to other websites and/or applications which are not owned or controlled by TalentVibes. Personal data from you may be collected on these other websites and/or applications when you visit such websites and/or applications and make use of the services provided therein. Where and when you decide to click on any advertisement or hyperlink on the Electronic Platforms which grants you access to another website and/or application, the protection of your personal data which are deemed to be private and confidential may be exposed in these other websites and/or applications. TalentVibes is not responsible for the privacy practices of such other websites and/or applications. You are strongly recommended to refer to the privacy policies of such other websites and/or applications before using them.

6. Data Retention:

6.1 Retention Period: We will retain your personal data only for as long as necessary to fulfill the purposes outlined in this Policy or as required by law. Once TalentVibes has obtained your personal data, it will be maintained securely in TalentVibes’ system for the period necessary to fulfill the purposes for which the data was collected (see section 2.2 above). Once a Registered User, you may terminate your membership of the App by contacting TalentVibes (see section 10 below on “Contact Information”). TalentVibes may retain your personal data even after you have closed your account if retention is reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes between users, prevent fraud and abuse, or enforce this Privacy Policy and other relevant terms. Once your personal data is no longer required, we will securely delete or anonymise it.

7. Your Rights

7.1 To Be Informed: You have the right to be informed of the existence and purpose of our processing activities.

7.2 Access and Rectification: You have the right to request access to the personal data we hold about you and receive a copy of that data. You may edit or amend your personal data at any time by logging into your profile on our Electronic Platforms (e.g. on our website or mobile applications) and editing your user profile preferences.

7.3 Erasure: You have the right to request the deletion of your personal data under certain circumstances, subject to legal obligations. If you are a Registered User, you may delete your personal data on the Electronic Platform and/or terminate your membership of our Electronic Platforms by contacting TalentVibes (see section 10 below on “Contact Information”). You may reach out to our Customer Relations team via email, live chat, Instagram direct, Facebook, or via web form to request the deletion of your user profile. Our team can also ensure your profile is no longer indexed on any form of Google search. TalentVibes may retain your personal data even after you have closed your account if retention is reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes between users, prevent fraud and abuse, or enforce this Policy. If you are clearing your TalentVibes Profile, please note that it may still be stored by TalentVibes in testing or backup systems for a period of time as long as reasonably necessary.

 

7.4 Restriction of Processing: You can request the restriction of the processing of your personal data in certain circumstances.

 

7.5 Data Portability: You may request that we transfer your personal data to another data controller in a structured, commonly used, and machine-readable format.

 

7.6 Object: You have the right to object to the processing of your personal data in certain situations, including direct marketing.

 

7.7 Not To Be Subject To Automated Decision-Making: You have the right not to be subject to a decision based solely on automated processing where that decision produces legal effects concerning you or has a significant impact on you.

 

7.8 Contacting TalentVibes For Assistance. If you need assistance with any of the above, please contact us through official channels and in such an event, TalentVibes may request that you provide personal details in order to verify your identity. TalentVibes will respond to your request as soon as reasonably possible. Should TalentVibes not be able to respond to your request within thirty (30) days after receiving your request, TalentVibes will inform you in writing within thirty (30) days of the time by which TalentVibes will be able to respond to your request. Where legally permitted, if TalentVibes is unable to assist you in your request, we shall generally inform you of the reasons why we are unable to do so.

 

8. Subscription of Newsletter(s), Promotional Material(s) and Marketing Material(s)

 

8.1 TalentVibes may from time to time send to candidates and Registered Users newsletters, information on job openings, events, classes, and marketing materials based on the information and data provided to TalentVibes. TalentVibes may use your data in direct marketing and TalentVibes requires your consent (which includes an indication of no objection) for that purpose. In this regard, please note that:

 

(a) your name, email, contact details, age, gender, date of birth, country of residence, nationality, education level, salary and work experience from time to time may be used by TalentVibes and/or its authorised personnel or staff in direct marketing;

 

(b) the following classes of services, products, and subjects may be marketed:

(i) job-hunting and agencies services offered other than by TalentVibes; (iii) various courses, programs, and career opportunities; (iii) special events hosted by TalentVibes, including but not limited to courses, workshops, and competitions;

(iv) Expert classes hosted by TalentVibes and invited experts and/or professionals; (v) reward, loyalty or privilege programs and related products and services; (vi) special offers including coupons, discounts, group purchase offers, and promotional campaigns; (vii) products and services offered by TalentVibes and Advertisers (the names of such affiliates and advertisers can be found in the application form(s) for the relevant products and services, as the case may be); (viii) donations and contributions for charitable and/or non-profit making purposes;

 

(c) the above products, services, and subjects may be provided or (in the case of donations and contributions) solicited by TalentVibes, third party service providers providing the products and services listed in paragraph (b) above, and charitable or non-profit making organisations;

 

(d) in addition to marketing the above services, products, and subject itself, TalentVibes also intends to provide the data described in paragraph (a) above to all or any of the persons described in paragraph (c) above for use by them in marketing those services, products, and subjects and TalentVibes requires your written consent (which includes an indication of no objection) for that purpose; and

 

(e) TalentVibes may receive money or other property in return for providing the data to the other persons in paragraph (d) above and when requesting your written consent, TalentVibes will inform you if TalentVibes receives any money or other property in return for providing the data to other persons. In this regard, you may choose to opt-out, sign up or unsubscribe for such materials by logging into the registration or Settings page, clicking on the automatic link appearing in each newsletter/message, or contacting TalentVibes (see section 10 below on “Contact Information”).

 

9. Changes to this Policy

 

TalentVibes reserves the right to update, revise, modify or amend this Policy at any time as TalentVibes deems necessary. You are strongly recommended to review this Privacy Policy frequently. If TalentVibes decides to update, revise, modify or amend this Policy, TalentVibes will post those changes to this webpage and/or other places as TalentVibes deems appropriate, so that you would be aware of what data TalentVibes collects, how TalentVibes uses it, and under what circumstances, if any, TalentVibes discloses it. Such changes to this Policy shall apply from the time that TalentVibes posts the same. Your continued use of the Electronic Platforms and services shall constitute acceptance of the changes to this Policy.

11. Terms Applicable to Specific Products and Platforms

 

11.1 Electronic Platforms:

Making an online application to a job advertisement or registering to TalentVibes on the TNEX application is an optional service that requires you to complete mandatory fields (e.g. first name, last name, phone, and email) so that Advertisers and/or TalentVibes can identify and contact you from time to time.

TalentVibes posts Registered Users’ testimonials on the Electronic Platforms, which may contain personally identifiable information such as the Registered Users’ names. TalentVibes shall obtain the Registered Users’ consent before posting the testimonials to post their names along with their testimonials.

 

11.2 TNEX App: To register and use our TalentVibes job searching app, personal data is collected including the following:

(a) name;

(b) contact information such as email address, phone number, mailing address;

(c) date of birth and nationality;

(d) gender;

(e) identification number (such as a national identity number);

(f) resume, and related information that is/are not otherwise publicly available, including but not limited to profile photo, salary, education level, work experience;

(g) device information (such as device type, browser type and IP addresses); and

(h) preferences and interests.

The purpose of collecting this data is outlined in Section 2.2 above. This data is used to enhance the quality and relevance of job recommendations and support you in your job searching process.
